General Terms and Conditions (GTC) for the Connext exchange platform
1. Scope
These General Terms and Conditions (GTC) apply to the use of the exchange platform provided by Connext GmbH. The platform serves to connect schools, teachers, parents, and students with learning resources. By registering and using the platform, users accept these GTC.
2. User groups and services
The platform is aimed at schools, teachers, parents, providers of learning opportunities, and students. Providers (hereinafter referred to as "providers") can post offers for courses, workshops, and other educational formats on the platform. Providers are responsible for the accuracy and completeness of their information.
3. Registration and user account
- Registration is required to use the platform. Users are obligated to provide truthful and complete information.
- The user account is personal and may not be shared with third parties.
- The operator reserves the right to terminate user accounts in case of violation of these terms.
- Terms and conditions or to block or delete users in case of misuse of the platform.
4. Contractual relationship between provider and user
- The Connext platform acts as an intermediary between providers and users. The operator is not a party to the contracts concluded between users and providers.
- The operator assumes no liability for the content and execution of the offers.
5. Obligations of the providers
- Providers are obliged to describe their offers truthfully and completely.
- Providers must ensure that their offers comply with applicable legal requirements and do not infringe the rights of third parties.
- Providers are obliged to provide the agreed services and make them available to users within the scope of the described offers.
- Texts and images published by a member on the marketplace in any way and form (offer, classified ad, rating, within the framework of the "questions and answers" function, etc.) may not aim at concluding contracts outside the marketplace or directly or indirectly solicit such contracts.
6. Usage fees
- Registration on the platform is free. The operator may charge fees for certain services or extended features. These will be clearly indicated in advance.
- Providers can offer their services for a fee or free of charge. Payment terms are agreed upon between the provider and the user.
7. Liability
- The operator is only liable for damages resulting from gross negligence or intent.
- The operator is not liable for the accuracy, completeness and quality of the content posted by providers, nor for the execution of the offers.
- The operator is not liable for damages arising from the use of the platform, in particular not for lost profits or other financial losses of the users.
8. Behavior on the platform
- Users are obliged not to use the platform for unlawful purposes.
- Offensive, discriminatory, racist or otherwise inappropriate content is prohibited.
- The operator reserves the right to delete content that violates these rules.
- All communication between providers and users must take place via the platform. Direct contact outside the platform is prohibited unless expressly authorized by the operator. This is for the safety of all users and to ensure the quality of the platform.
9. Termination
- Users can terminate their account at any time without giving reasons.
- The operator reserves the right to terminate user accounts in the event of a violation of these terms and conditions or for good cause.
10. Data protection
The collection, processing, and use of personal data is carried out in accordance with applicable data protection regulations. Further information can be found in the platform's privacy policy.
11. Changes to the Terms and Conditions
The operator reserves the right to change these terms and conditions at any time. Users will be informed of any changes and must accept them in order to continue using the platform.
12. Applicable Law
Swiss law applies. The place of jurisdiction is the operator's registered office.
